The Company is a recruitment business which provides work-finding services to its clients and work-seekers (henceforth known as candidates). The Company must process personal data (including sensitive personal data) so that it can provide these services – in doing so, the Company acts as a data controller.

You may give your personal details to the Company directly, such as on an application or registration form or via our website, or we may collect them from another source such as a jobs board. The Company must have a legal basis for processing your personal data. For the purposes of providing you with work-finding services and/or information relating to roles relevant to you we will only use your personal data in accordance with the terms of the following statement.

The Company will collect your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with work-finding services. The legal bases we rely upon to offer these services to you are:

Where the Company has relied on a legitimate interest to process your personal data our legitimate interests is/are as follows:

The Company provide work finding services to both candidates and clients as part of their business. They process personal data in order to be able to provide these services – they need to check the identity of candidates, their right to work and qualifications. It is in the legitimate interests of all parties involved – the recruiter, the candidate and the client – that the recruitment business can process personal data.

C. Recipient/s of data
The Company will process your personal data and/or sensitive personal data with the following recipients:

  • Clients who are using the Company to source candidates for vacancies, where the candidate’s
    details have been anonymised or explicit agreement has been received to share their details

 

2. Data retention

The Company will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services.

As the Company is processing your data based on legitimate interest, we will keep basic details such as those shown on LinkedIn or a CV for up to 3 years, as it is reasonable to expect candidates to only move jobs every 2-3 years. We will endeavour to contact candidates every 6-12 months in order to keep our records as up to date as possible and will ensure all candidates are contacted before their details are passed to any third parties.

3. Your rights

Please be aware that you have the following data protection rights:

  • The right to be informed about the personal data the Company processes on you;
  • The right of access to the personal data the Company processes on you;
  • The right to rectification of your personal data;
  • The right to erasure of your personal data in certain circumstances;
  • The right to restrict processing of your personal data;
  • The right to data portability in certain circumstances;
  • The right to object to the processing of your personal data that was based on a public or legitimate interest;
  • The right not to be subjected to automated decision making and profiling; and
  • The right to withdraw consent at any time.

Where you have consented to the Company processing your personal data or they are doing so through legitimate interest, you have the right to withdraw that consent at any time by contacting Claire Watt at Claire.watt@montgomerywatt.com

4. Automated decision-making

The company uses basic automated decision making via excel. Candidate’s details are listed with their name, job title, qualification, general location, sector experience and broad skill set i.e. Management Account, Auditor, FC etc.

The Company then filters candidate’s details to decide which candidates to call regarding new Client engagements. This search is then cross referenced against detailed candidate notes where candidate preferences have been listed. Where there is a 50%+ match candidates will be contacted to see if they are suitable and interested. This call will also be used to update candidate
preferences.

5. Use of ‘cookies’

Like many other websites, the Montgomery Watt website uses cookies. ‘Cookies’ are small pieces of information sent by an organisation to your computer and stored on your hard drive to allow that website to recognise you when you visit. They collect statistical data about your browsing actions and patterns and do not identify you as an individual. This helps us to improve our website and deliver a better more personalised service.

These cookies are used to collect information about how visitors use our site. We use the information to compile reports and to help us improve the site.
